Agreement to These Terms
These Terms of Use (“Terms”) govern your use of K Mic (“the App”), which is developed and operated by Heap Labs LLC (“Heap Labs,” “we,” “us,” or “our”). By downloading, purchasing, or using the App, you agree to these Terms.
If you downloaded K Mic from Apple’s App Store, Apple’s Standard End User License Agreement (EULA) also applies and is incorporated into these Terms. If these Terms conflict with Apple’s Standard EULA, the Standard EULA controls to the extent of the conflict.
What K Mic Does
K Mic processes microphone audio in real time and routes it to an output you select. It also provides voice effects and audio controls. Performance depends on your device, operating system, network, connected speaker, environment, and other factors outside our control. The App is not intended for emergency communication, safety-critical use, or professional medical applications.
You are responsible for using the App lawfully, obtaining any consent required before amplifying another person’s voice, and keeping playback volume at a safe level.
Auto-Renewable Subscriptions
K Mic may offer weekly and annual auto-renewable subscriptions that unlock premium features. The available plan, billing period, price, and any free-trial or introductory-offer terms are displayed in the App before you confirm a purchase. Prices may vary by country and are charged in the currency shown by the App Store.
Payment is charged to your Apple ID at confirmation of purchase. Unless you cancel, your subscription automatically renews for the same billing period. Your account is charged within 24 hours before the current period ends at the price presented for renewal.
If a free trial is offered, any unused portion of that trial is forfeited when you purchase a subscription, where applicable. After a trial ends, the subscription renews at the displayed price unless you cancel at least 24 hours before the trial or billing period ends.
Managing, Cancelling, and Restoring
You can manage or cancel an iOS subscription in Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current paid period, and you retain access until then. Deleting K Mic does not cancel a subscription.
You can restore an eligible purchase from the restore-purchases option in K Mic while signed in with the Apple ID used for the original purchase. Apple processes payments and refunds. Refund requests can be submitted at reportaproblem.apple.com.
License and Acceptable Use
Subject to these Terms, Heap Labs grants you a limited, non-exclusive, non-transferable, revocable license to use K Mic for personal or internal business purposes on devices you own or control, as permitted by the applicable app store rules.
You may not:
- Use the App in violation of applicable law or others’ rights.
- Copy, resell, sublicense, distribute, or commercially exploit the App except as applicable law expressly permits.
- Reverse-engineer, bypass access controls, interfere with the App, or attempt to extract its source code except where the law does not allow that restriction.
- Use K Mic to harass, deceive, impersonate, surveil, or record someone without any consent required by law.
Ownership and Third-Party Services
K Mic, including its software, design, branding, and content, is owned by Heap Labs or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership to you.
K Mic relies on services and hardware provided by Apple, RevenueCat, Bluetooth-device makers, and other third parties. Their terms and privacy practices may apply to your use of those services. Heap Labs is not responsible for third-party products or services it does not control.
Disclaimers and Limitation of Liability
To the fullest extent permitted by law, K Mic is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted operation, compatibility with every speaker or device, a particular latency, or error-free audio. Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable consumer law.
To the fullest extent permitted by law, Heap Labs is not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, lost profits, hearing damage caused by unsafe volume, or losses arising from third-party devices or services. Our total liability relating to K Mic will not exceed the amount you paid for the App during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Privacy
Our processing of information is described in the K Mic Privacy Policy, which is incorporated into these Terms.
Changes and Termination
We may update the App or these Terms as the service or legal requirements change. We will post revised Terms here and update the date above. We may suspend access if you materially violate these Terms. Provisions that by their nature should survive termination will remain in effect.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except that mandatory consumer protections in your place of residence continue to apply.
